    In an unexpected turn of events, attorneys Steven A. Schwartz and Peter LoDuca found themselves facing potential repercussions in federal court on Thursday as they defended a court filing that included fabricated legal research. The lawyers blamed the artificial intelligence-powered chatbot, ChatGPT, for tricking them into including references to non-existent court cases in a lawsuit against Colombian airline Avianca.

    Schwartz explained that he had turned to ChatGPT to find legal precedents supporting his client’s case regarding an injury sustained during a 2019 flight. The chatbot, renowned for generating detailed responses to user prompts, suggested several aviation-related cases that Schwartz had been unable to locate through conventional research methods used at his law firm. Unfortunately, it turned out that some of those cases were entirely fabricated or involved airlines that did not exist.

    During a hearing in Manhattan before U.S. District Judge P. Kevin Castel, Schwartz admitted to operating under a mistaken belief that the chatbot had access to sources beyond his reach. He acknowledged his failure to conduct proper follow-up research to verify the accuracy of the citations, stating that he had not realized ChatGPT could invent cases.

    The incident has drawn attention to concerns surrounding artificial intelligence and its potential impact on human work and learning. Microsoft’s investment of $10 billion in OpenAI, the company behind ChatGPT, highlights the significance of AI technology.     Judge Castel expressed both bewilderment and concern over the unusual situation that unfolded in his courtroom. He expressed disappointment that the lawyers did not promptly rectify the false legal citations when alerted by Avianca’s lawyers and the court itself. Avianca had pointed out the fraudulent case law in a filing submitted in March.

    To illustrate the extent of the problem, the judge cited one specific case invented by ChatGPT. Initially described as a wrongful death case involving a woman and an airline, it later transformed into a claim about a man who missed a flight and incurred additional expenses. Castel questioned the validity of the case, asking if both parties could agree that it was “legal gibberish.”

    Schwartz acknowledged his mistaken belief that the confusing presentation resulted from excerpts taken from different parts of the case. When given the opportunity to speak, he sincerely apologized, expressing personal and professional remorse for the blunder. Schwartz assured the court that measures had been implemented to prevent a recurrence of such errors at his law firm.

    LoDuca, the other lawyer involved in the case, stated that he had trusted Schwartz and had not adequately reviewed the compiled research. After the judge read excerpts from one of the cited cases to demonstrate its nonsensical nature, LoDuca admitted that he had never considered the possibility of the case being bogus. He expressed deep regret over the outcome.

    Ronald Minkoff, an attorney for the law firm, argued that the submission resulted from carelessness rather than bad faith and should not warrant sanctions. He emphasized the historical difficulty lawyers face with new technology and their struggles to adapt to evolving tools. Minkoff described Schwartz’s use of ChatGPT as playing with live ammunition.

    Legal experts have taken notice of the case, with Daniel Shin, an adjunct professor and assistant director of research at the Center for Legal and Court Technology at William & Mary Law School, highlighting its significance. Shin noted that this was the first documented instance of potential professional misconduct by an attorney involving generative AI. He underscored the lawyers’ lack of understanding regarding how ChatGPT operates, often generating realistic-sounding but fictional information.

    Judge Castel reserved his decision on potential sanctions for a later date. The judge recognized the seriousness of the situation and the need to carefully consider the appropriate course of action.

    The incident involving Schwartz and LoDuca has garnered attention not only within the courtroom but also within the legal community.
