    (TechGenez) – Anthropic filed a federal lawsuit Monday seeking to block the United States Department of War from designating the company a “supply chain risk,” claiming the unprecedented action against a U.S. AI firm violates free speech and due process rights.

    The complaint, filed in U.S. District Court in California, asks the court to declare the designation unlawful and issue an injunction preventing federal agencies from enforcing it. The move escalates a months-long standoff over Anthropic’s refusal to remove contractual safeguards prohibiting the use of its Claude models for mass domestic surveillance and fully autonomous lethal weapons.

    The designation, imposed last week, bars government contractors from using Anthropic technology in military-related work and threatens the company’s partnerships across defense and intelligence agencies.

    Lawsuit Claims

    Anthropic argues the label is legally baseless and retaliatory:

    • Violates First Amendment free speech protections by punishing the company for maintaining ethical restrictions
    • Denies due process by applying a foreign-adversary designation without formal hearing or evidence of security compromise

    CEO Dario Amodei stated: “We remain open to reasonable negotiations, but we will vigorously defend our right to set principled boundaries on technology that can profoundly impact democratic values and human life.”

    Department of War Position

    The Department of War has not yet responded to the filing. Defense Secretary Pete Hegseth previously stated unrestricted access to frontier AI is essential for national defense and accused Anthropic of attempting to dictate military operations.

    The designation followed President Trump’s order directing federal agencies to phase out Anthropic technology over six months after the company refused to drop the restrictions.

    Broader Context

    The lawsuit represents the first direct legal challenge to a “supply chain risk” designation against a domestic technology company. The label, typically applied to foreign entities, carries significant reputational and commercial consequences.

    Anthropic has positioned itself as the most safety-conscious frontier AI developer, consistently maintaining stricter red lines than competitors on certain military and surveillance applications.

    The dispute occurs amid accelerating U.S.-China AI competition, renewed export controls on advanced semiconductors, and congressional debate over military AI governance.

    A small group of employees from OpenAI and Google filed an amicus brief supporting Anthropic’s position, arguing that enforceable safety boundaries are essential for responsible AI development in democratic societies.
